What is Trademark Renewal?
A registered trademark lasts 10 years from the application date — then it must be renewed via Form TM-R, or it expires and is eventually removed from the register. Renewal can be filed up to one year before expiry, and within a 6-month grace period after expiry with surcharge.
Letting a mark lapse is dangerous: removal opens the door for competitors to register similar marks, and restoration (TM-13 route) within one year of removal is discretionary, slower and costlier than timely renewal.

Frequently Asked Questions
When can I renew my trademark?
Any time within 12 months before expiry at the normal fee, or within 6 months after expiry with surcharge. After that, the mark faces removal and only restoration can revive it.
What are the renewal fees?
Government fee is ₹9,000 per class (e-filing) for timely renewal; renewal with surcharge after expiry costs ₹4,500 extra per class. Our professional fee covers status check, filing and confirmation.
What if my trademark already expired?
Within 6 months of expiry: renew with surcharge. After removal from the register: file for restoration + renewal (TM-13/TM-R route) within one year of removal — discretionary, so act fast. We assess and take the correct route.
Do I need to prove use for renewal?
No use evidence is required for renewal in India. However, a mark unused for 5+ continuous years becomes vulnerable to third-party non-use cancellation — keep using it in commerce.
Can renewal be filed by the new owner after assignment?
The recorded proprietor should renew. If the mark was assigned, record the assignment (TM-P) — we typically file recordal and renewal together to keep the register clean.
How many times can a trademark be renewed?
Indefinitely — every 10 years. Some of the world’s oldest brands have century-old registrations kept alive purely through timely renewals.
Will I get a new certificate?
The Registry updates the register and issues renewal confirmation; the mark continues under the same registration number with a new validity period.
