What is Patent Registration?
A patent gives you a 20-year monopoly over your invention — the right to stop anyone from making, using, selling or importing it in India. To qualify, an invention must be novel, involve an inventive step and be industrially applicable, under the Patents Act, 1970.
The specification is everything: claims drafted too narrowly invite easy workarounds; drafted too broadly they get rejected. What can be patented in India?
A product or process that is novel, inventive and industrially applicable. Section 3 excludes mathematical/business methods, computer programs per se, mere discoveries, traditional knowledge and treatment methods — though software inventions with technical effect/hardware interplay are regularly granted with the right drafting.
Provisional vs complete specification — which first?
A provisional locks your priority date cheaply while the invention matures; the complete specification with claims must follow within 12 months. If your invention is fully developed, filing complete directly saves a step. We advise per case.
How much does patenting cost?
Government fees for individuals/startups/MSMEs: ₹1,600 filing + ₹4,000 examination (e-filing); larger entities pay ~5x. With professional drafting (the real work), budget ₹40,000–₹80,000 to grant for most inventions — spread over 2–4 years. We quote stage-wise.
How long does it take to get a patent?
Ordinarily 3–5 years. With expedited examination (startups, women inventors, etc.) grants now come in as little as 1–2 years. “Patent pending” status protects your market position from day one of filing.
What is the First Examination Report (FER)?
The examiner’s objections on novelty, inventive step and formalities. You must respond within 6 months (extendable by 3). Most patents are won or lost at this stage — our agents argue amendments and distinctions over cited art.
Do I need to keep paying after grant?
Yes — annual renewal fees from the 3rd year onwards keep the patent alive (rising with age, ₹800–₹4,000/year for small entities). Miss them and the patent lapses; we track renewals for all clients.
Should I file in India first or internationally?
Indian residents must file in India first or obtain a foreign-filing licence (Section 39). From your Indian filing, the Paris route (12 months) or PCT route (30/31 months to national phase) takes you global. We plan the strategy with your budget.
What if someone infringes my patent?
Civil remedies include injunctions, damages or account of profits in commercial courts. A granted, well-drafted claim set is your weapon — which is why drafting quality matters more than anything else in this process.
