Section 8 company vs Trust vs Society — which is best?

Section 8 offers the strongest governance, national recognition and donor confidence — best for CSR and institutional funding. Trusts are simpler and suit family philanthropy; societies suit membership organisations. For serious fundraising we recommend Section 8.

How many people are needed to start a Section 8 company?

Minimum 2 directors and 2 shareholders (can be the same individuals) for a private Section 8 company. At least one director must be resident in India.

Can a Section 8 company make profits?

It can generate surplus, but every rupee must be applied to its charitable objects. Dividends to members are prohibited, and remuneration must be reasonable.

What are 12A and 80G registrations?

12A exempts the NGO’s income from income tax; 80G entitles your donors to claim a deduction (generally 50%) on donations. Both are applied via Form 10A — new NGOs get provisional registration valid 3 years.

Can a Section 8 company receive CSR funding?

Yes — after filing Form CSR-1 with the MCA. Many corporates also expect 12A/80G and a track record, which we help you plan for.

Can it receive foreign donations?

Only after FCRA registration, which generally requires 3 years of existence and ₹15 lakh spent on core activities. Prior-permission route is available for specific foreign grants before that.
