Power of Attorney
Authorise someone you trust to act for you — general and special PoAs drafted with precise powers and revocability.
- Act From Anywhere
- Powers Precisely Scoped
- Revocable by Design
What is Power of Attorney?
A Power of Attorney lets your chosen person legally act on your behalf — manage property, operate accounts, sign documents, represent you before authorities — essential for NRIs, senior citizens and anyone whose affairs run in a city they don't. Its power is also its danger: a loosely drafted PoA is a blank cheque.
Taxwapsi drafts PoAs with surgical scope: General PoA (defined domains of management) or Special PoA (one transaction — sell flat X, attend registration Y), each power enumerated expressly, durations and conditions set, and revocation mechanics built in. Sale-related authority is drafted with the post-2011 Suraj Lamp reality in mind — courts do not recognise "PoA sales" as transfers, so the PoA supports a proper registered conveyance rather than replacing one.
For NRIs, we manage the full cross-border chain: drafting to Indian requirements, execution before the consulate or notary abroad, apostille where applicable, and adjudication/stamping in India within the statutory window so the document actually works when presented.
Expert Pro Tip
Never give an open-ended general PoA when a special PoA will do — enumerate exact powers, add an expiry date, and for property transactions name the specific property. Misused blanket PoAs are among the most litigated documents in India.

Frequently Asked Questions
General vs Special PoA — which do I need?
Special PoA authorises defined act(s) — sell one flat, attend one registration, operate one account — and dies with the task. General PoA covers ongoing management across listed domains. Default to special; grant general only for genuine continuing management, with safeguards. Our consultation settles this in minutes.
Does a PoA need registration?
Notarisation suffices for most purposes, BUT a PoA authorising execution/presentation of registrable property documents is required by many Sub-Registrars (and several states' rules) to be registered or executed before specified authorities. For property work, we draft to the standard your Sub-Registrar will actually accept.
Can property be sold through a PoA?
A PoA can authorise the attorney to execute and register a proper sale deed for the owner. What the Supreme Court (Suraj Lamp, 2011) outlawed is treating PoA+agreement+will bundles AS the transfer itself. Legitimate attorney-executed conveyances remain valid — drafted with specific-property authority and correct execution.
How does an NRI execute a PoA?
Sign before the Indian consulate (or local notary with apostille, for Hague Convention countries), courier to India, then have it stamped/adjudicated in India within 3 months of receipt (Section 18, Stamp Act). Skipping the Indian stamping step is the classic reason NRI PoAs get rejected — our checklist prevents it.
When does a PoA end?
On revocation, expiry of stated term, completion of the special purpose, or death/insanity/insolvency of the principal. (A PoA "coupled with interest" — securing the attorney's own interest — is irrevocable to that extent.) Note: ordinary PoAs do NOT survive death; succession documents take over.
How do I revoke a PoA?
Execute a revocation deed (registered, if the PoA was registered), serve notice on the attorney, and notify third parties who relied on it (banks, registrar, tenants); public-notice publication is prudent for property PoAs. Acts done before notice may still bind — revoke formally, not verbally.
Is a PoA holder personally liable?
Acting within authority, the principal is bound, not the attorney. Exceeding authority or self-dealing exposes the attorney personally — and our safeguard clauses (no self-purchase, reporting duties, no sub-delegation without consent) make the boundaries explicit.
What stamp duty applies to a PoA?
Modest fixed duties for ordinary PoAs (₹100–₹500 typical by state) — but a PoA given for consideration or authorising sale to the attorney themselves can attract conveyance-level duty in several states. Structure determines cost; we flag it before execution.
