What is Consumer Complaint?

Defective products, services never delivered, builders sitting on possession, insurance claims wrongly repudiated, hospital negligence — the Consumer Protection Act, 2019 gives you a dedicated, low-cost forum with real teeth: refund, replacement, compensation for harassment and litigation costs.

Jurisdiction is value-based: District Commission up to ₹50 lakh (fees start as low as nil-to-₹200 for small claims), State Commission up to ₹2 crore, National Commission above. E-commerce disputes are squarely covered, e-filing (e-Jagriti) works from home, and you can argue in person — though drafted-right complaints with documented deficiency win; emotional narratives don't.

Taxwapsi handles the full arc: a pre-complaint legal notice (which alone resolves many matters), complaint drafting with deficiency/defect framed to the Act's language, evidence affidavits, e-filing in the correct forum, and guidance through hearings — including execution if the opposite party ignores the order.

Expert Pro Tip

File where YOU reside or work — the 2019 Act lets complainants sue at their own place, ending the era of companies hiding behind distant "exclusive jurisdiction" clauses. Combined with e-filing, your complaint costs them more inconvenience than you.

Benefits of Consumer Complaint

Real Remedies

Refund with interest, replacement, deficiency compensation, mental-agony damages and costs — commissions award all of these routinely.

Low-Cost Forum

Court fees from nil (claims up to ₹5 lakh) to modest slabs — designed for consumers, not corporations.

Your Home Turf

Complaint lies where you reside/work or where the cause arose — their fine-print jurisdiction clauses don't override the Act.

E-Filing From Home

e-Jagriti filing, video hearings in many commissions — justice without travel.

Builder & Insurer Accountability

Possession delays, claim repudiations and unfair terms are core consumer-forum territory with strong precedent.

Notice-Stage Settlements

Many companies settle at our pre-complaint notice — resolution without ever filing.

Frequently Asked Questions

Who counts as a "consumer" under the Act?

Anyone who buys goods or hires services for consideration — including online purchases and offline deals, and goods bought for self-employment livelihood. Excluded: purchases for resale or pure commercial purpose. The 2019 Act explicitly covers e-commerce and tele-shopping transactions.

Which forum do I file in, and what does it cost?

By claim value: District Commission up to ₹50 lakh, State up to ₹2 crore, National above ₹2 crore. Fees are consumer-friendly: NIL up to ₹5 lakh claims, then modest slabs (₹200 up to ₹10 lakh, rising gradually). Territorially: where you reside/work, where they operate, or where the cause arose — your choice.

Is there a time limit for filing?

Two years from when the cause of action arose — with condonation possible for sufficient cause. For continuing wrongs (builder possession delay), the cause continues; for one-time defects, the clock runs from discovery. Don't sit on claims; limitation objections are the lazy defence every company tries first.

What compensation can I actually expect?

Refund of consideration with interest (commissions commonly award 6–12%), replacement/repair, compensation for deficiency and mental agony (scaled to facts), and litigation costs. Punitive elements appear in egregious cases. Realistic claim framing — our job — wins; inflated claims invite skepticism.

Do I need a lawyer to appear?

No — consumer fora permit personal appearance, and our drafted complaint + written versions are built to be argued by you where you prefer. For higher-value or technical matters (medical negligence, builder cases), representation helps; we coordinate it as needed.

Can I file against e-commerce platforms or only the seller?

Both, appropriately — the E-Commerce Rules, 2020 place duties on platforms (grievance officers, refund timelines, no unfair practices), and platforms are routinely arrayed alongside sellers, especially for platform-fulfilled orders and payment failures. We array parties to maximise recovery odds.

What about builder delay cases — consumer forum or RERA?

Both remedies coexist (Supreme Court affirmed election between them). RERA suits project-level grievances and interest-on-delay formulas; consumer fora suit refund-with-compensation claims and pre-RERA projects. We pick the forum by your outcome priority — refund vs possession vs compensation.

The company ignored the commission's order. Now what?

Execution under Section 71 (civil-court enforcement powers) and Section 72 — non-compliance is punishable with imprisonment up to 3 years and fines. Companies comply quickly once execution issues; our Pro plan stays with you through it.
