Is registration required for copyright to exist?
No — copyright arises automatically on creation. But in disputes, proving ownership and date without a certificate is hard. Registration gives prima facie evidence that courts, platforms and customs act on.
What is the government fee for copyright registration?
It varies by work type: ₹500 per literary/dramatic/musical/artistic work, ₹2,000 for works used on goods, ₹5,000 per cinematograph film and ₹2,000 per sound recording. Software is filed as a literary work (₹500).
How long does registration take?
A mandatory 30-day objection window follows filing, then examination. Clean applications typically complete in 2–4 months; discrepancy letters or objections extend this. The diary number from day one already evidences your claim date.
How is copyright different from trademark and patent?
Copyright protects creative expression (content, code, art); trademark protects brand identifiers (names, logos); patents protect inventions. A software product may need all three — code (copyright), name (trademark), novel method (patent).
Can I register a mobile app or website?
Yes — the source code registers as a literary work; the UI/artwork can be registered separately as artistic works. We structure multi-element filings so each asset is properly covered.
Who owns work made by employees or freelancers?
Employee work made in the course of employment vests in the employer. Freelancer work belongs to the freelancer unless assigned in writing — get assignment clauses signed. Author NOC is filed when applicant ≠ author.
What does “artistic work used on goods” mean?
If your artwork (e.g. a label or logo) is used on products, Section 45 requires a Trademark Registry search certificate (TM-C) confirming no identical/similar trademark exists, before copyright registration. We obtain it as part of the process.
How long does copyright protection last?
Literary, dramatic, musical and artistic works: author’s lifetime + 60 years. Films, sound recordings, posthumous/anonymous works and works of companies/government: 60 years from publication.
