What qualifies for design registration?
Features of shape, configuration, pattern, ornament or composition of lines/colours applied to an article that appeal to the eye — judged solely by visual appearance. Functional features, trademarks and artistic works per se are excluded.
Design vs patent vs copyright — which protects my product?
Design protects how the product looks; patent protects how it works; copyright protects creative works like art/code. A gadget could have all three. If the appeal is visual, design registration is the right, fast tool.
Why must I file before launching?
Novelty is destroyed by prior publication anywhere in the world — including your own marketing. Unlike some countries, India has no general grace period, so file first, launch after.
What is the Locarno classification?
The international system classifying articles into 32 classes (e.g. class 9 packaging, 6 furnishing, 2 apparel). Registration protects the design as applied to articles of the filed class — choosing correctly defines your protection.
How long does registration take and what does it cost?
Typically 4–8 months for clean applications. Government fee is ₹1,000 for individuals/startups/small entities (₹4,000 for others) per application; extension of term costs ₹2,000/₹8,000 respectively.
How long does protection last?
10 years from registration, extendable once by 5 years (apply before expiry of the initial term). After expiry, the design enters the public domain.
What remedies exist against copying?
Section 22 provides damages up to ₹25,000 per contravention recoverable as contract debt (capped ₹50,000 per design), or a suit for injunction and damages — quick, effective relief against knock-offs.
Can I register a GUI or icon as a design?
GUIs/icons displayed on screens have been accepted in class 14-04 following recent practice — wording and representations must be crafted carefully. Our specialists handle screen-design filings.
