Frequently Asked Questions
Why are rent agreements made for 11 months?
Leases of 12 months or more require compulsory registration under the Registration Act, 1908. An 11-month agreement keeps registration optional, saving cost and time — which is why it became the Indian standard. For longer terms, registration is mandatory and we handle it.
Is notarisation enough, or does it need registration?
For up to 11 months: correct stamp duty + signatures suffice; notarisation adds evidentiary comfort but is not legally required. For 12+ months: registration at the Sub-Registrar is mandatory — an unregistered long lease is inadmissible to prove tenancy terms.
How much stamp duty applies?
It varies by state — e.g. Maharashtra charges 0.25% of (rent + deposit-linked) value for the term; Delhi commonly ₹100–200 stamp paper for 11 months; UP/Karnataka have their own slabs. We compute your state's exact duty as part of the service.
How much security deposit can a landlord take?
No central cap currently binds private agreements (the Model Tenancy Act suggests 2 months for residential, adopted state-by-state); markets range from 1–2 months (North India) to 5–10 months (Bengaluru). What matters legally is documenting refund timelines and permissible deductions — our drafts do.
What is a lock-in period?
A minimum period during which neither side may terminate — tenant leaving early forfeits/pays the lock-in rent; landlord evicting early compensates. Enforceable when drafted reasonably, and the single best protection for both sides' planning.
Can the landlord increase rent mid-term?
Only if the agreement provides for it. Standard practice: fixed rent for the term, with an escalation clause (5–10%) applying on renewal. Our drafts make escalation automatic so renewals don't reopen negotiation.
On what grounds can a tenant be evicted?
Per the agreement and state rent laws: non-payment, subletting without consent, misuse, damage, owner's bona fide requirement, and term expiry. Self-help eviction (lockouts, utility cuts) is illegal — proper notice per the agreement is the lawful route, which is why notice clauses matter.
Does a rent agreement work for HRA claims?
